1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you (the "Customer" or "User") and The Trail Tales ("Company", "we", "us", or "our"), governing your access to and use of our website (thetrailtales.com) and any orders placed for our products.

By browsing our catalogue, registering an account, or placing an order, you represent and warrant that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Return & Refund Policy.

2. Eligibility & User Accounts

To make a purchase or create an account, you must be at least 18 years of age and competent to enter into a legally enforceable contract under the Indian Contract Act, 1872. If you are under 18 years of age, you may use our platform only with the consent and supervision of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your login credentials and are solely liable for all activities that occur under your account. We reserve the right to suspend or terminate accounts that provide fraudulent or inaccurate registration details.

3. Product Details & Pricing

The Trail Tales crafts artisanal, long-lasting fragrances in various sizes (including 10ml, 50ml, and 100ml bottles). We make reasonable efforts to display fragrance notes, accords, bottle volumes, and imagery as accurately as possible. Because sensory experience varies by individual body chemistry, olfactory impressions are descriptive in nature.

All prices are listed in Indian Rupees (INR, ₹) and include applicable taxes (GST) unless indicated otherwise. We reserve the right to revise prices, correct typographical pricing errors, or withdraw promotional codes at any time prior to order confirmation.

4. Orders, Payments & Order Verification

We offer two modes of order placement:

• Prepaid Orders: Processed securely via our payment gateway partner, Razorpay, using UPI, Credit/Debit cards, or Net Banking.
• Cash on Delivery (COD): Available for eligible domestic pincodes. We reserve the right to verify COD orders via telephone or WhatsApp before fulfillment.

We reserve the right to cancel or refuse any order due to unavailability of stock, suspected fraud, incomplete shipping details, non-serviceable pincodes, or recurring refusal of COD deliveries.

5. Shipping & Delivery

Orders are dispatched from our primary fulfillment facility in Palghar, Maharashtra 401404, India via ShipRocket and accredited national courier networks. Standard delivery timelines range from 3 to 7 business days depending on delivery destination and local logistics conditions.

While we strive for prompt delivery, delays arising from force majeure events, natural disasters, strikes, or regional courier disruptions remain outside our direct control. Risk of loss passes to the customer upon delivery confirmation by the courier provider.

6. Strict No-Refund & No-Return Policy

Due to the personal hygiene, sanitary, and cosmetic nature of perfumery goods, all sales are strictly final. We do not accept returns, exchanges, or provide monetary refunds once an order is confirmed or delivered.

Transit Damage Exception: In the rare event that an item arrives physically broken or leaking, you must notify our customer care within 24 hours of delivery with unedited unboxing video evidence. Please see our full Return & Refund Policy for complete instructions.

7. Intellectual Property & Copyright

All content on this website—including but not limited to brand names, logos ("The Trail Tales"), bottle designs, product descriptions, olfactory profiles, graphical assets, photography, software code, and UI elements—is the exclusive intellectual property of The Trail Tales and is protected under the Indian Copyright Act, 1957 and Trade Marks Act, 1999.

No portion of this website may be copied, reproduced, distributed, republished, scraped, or modified without prior express written authorization from us.

8. Health & Allergy Disclaimer

Our fragrances are formulated using quality perfumery materials, aroma molecules, and denatured alcohol. Individual skin reactions and sensitivities can vary. We advise performing a small patch test on your inner wrist before regular wear. Do not apply to broken or irritated skin, and avoid contact with eyes. Keep out of reach of infants and pets. We disclaim any liability for adverse allergic reactions arising from personal sensitivities.

9. Governing Law & Dispute Jurisdiction

These Terms, transactions, and any disputes arising out of or related to our products or services shall be governed and construed in accordance with the laws of the Republic of India.

Any dispute, claim, or legal proceeding shall be subject to the exclusive jurisdiction of the competent civil courts in Palghar, Maharashtra, India.
